This Privacy Policy explains how Markion AI, a company based in Mexico ("Markion," "we," "us," or "our"), collects, uses, shares, and protects personal data when you use markion.ai and the related Markion services (collectively, the "Service"). Markion AI is responsible for the personal data described in this policy.

This policy does not govern websites, applications, or services operated by third parties. When you connect a third-party service to Markion, that provider's own privacy notice also applies to its handling of your data.

1. Personal data we collect

We collect only the information reasonably needed to operate the Service. Depending on how you use Markion, this may include:

• Account and contact data needed to create and manage your account.
• Business data you provide to configure and use Markion.
• Customer content you create, upload, or generate through the Service.
• Billing and subscription data. Paddle processes payment-card details; Markion does not receive or store your full card number.
• Connected-account data needed to use third-party services you authorize.
• Technical and usage data needed for security, diagnostics, and Service operation.
• Communications and information you send when contacting us.

Markion is not designed to collect sensitive personal data. Please do not include government identifiers, payment-card numbers, health information, biometric data, precise location, or other sensitive information in prompts, business profiles, uploads, or customer content.

2. How we collect data

We receive data directly from you when you create or configure an account, enter business information, create content, connect another service, subscribe, or contact us. We also receive limited data automatically through essential cookies, local storage, server logs, and operational telemetry. Auth0, Paddle, and services you choose to connect may send us the account, billing, or authorization information needed to complete your request.

3. How we use personal data

We use personal data for the following purposes:

• Create and secure your account, authenticate you, and remember essential preferences.
• Provide Markion's marketing planning, content generation, scheduling, and publishing features.
• Process subscriptions, maintain billing records, and provide billing support.
• Connect to and act on services you authorize, including WordPress, Facebook, Instagram, and TikTok.
• Respond to requests, provide support, and send essential service or security communications.
• Monitor reliability, diagnose errors, prevent fraud or abuse, and protect Markion, its users, and the public.
• Comply with applicable law, enforce our agreements, and establish, exercise, or defend legal claims.

We do not use personal data for unrelated purposes. If we need to use it for a materially different purpose, we will provide notice and obtain consent when required by law.

4. Legal bases

We process personal data with your consent and as necessary to provide the Service and fulfill our relationship with you. Where applicable law requires a specific legal basis, we rely on performance of a contract, compliance with legal obligations, your consent, and our legitimate interests in securing, supporting, and improving the reliability of the Service, provided those interests do not override your rights.

5. When we disclose data

We do not sell or rent personal data. We disclose only the data needed for the following recipients to perform the stated function:

• Auth0, for identity and authentication services.
• Paddle, our merchant-of-record and billing provider, for checkout, payments, subscriptions, tax, fraud prevention, and billing support.
• Cloud hosting, storage, security, and operational telemetry providers.
• WordPress, Meta services (Facebook and Instagram), and TikTok, only when you connect them or direct Markion to publish or retrieve permitted account information.
• Professional advisers, auditors, insurers, courts, regulators, law enforcement, or other parties when reasonably necessary to comply with law or protect legal rights and safety.
• A successor in connection with a merger, financing, reorganization, or sale of all or part of the business, subject to appropriate confidentiality and notice requirements.

Service providers may process data only to provide contracted services to Markion or as independently required by law. Connected services process data under their own terms and privacy notices.

6. International data transfers

Markion is based in Mexico, and our service providers may process data in Mexico, the United States, and other countries where they operate. Those countries may have privacy laws different from those where you live. We use contractual and other reasonable safeguards required by applicable law for international processing and transfers.

7. Cookies and operational telemetry

Markion uses cookies and similar local-storage technologies that are necessary for authentication, session security, language, theme, time-zone preferences, and core site operation. We also use limited operational telemetry to understand errors, performance, reliability, and security. We do not use advertising cookies or cross-site behavioral tracking.

Blocking essential cookies may prevent account login or other Service features from working correctly. Because Markion does not sell personal data or use cross-site advertising, browser opt-out signals do not change those practices.

8. Data retention and deletion

We retain personal data while your account is active and only as needed to provide the Service. When you delete or disable your account, Markion deletes or de-identifies the personal data and customer content associated with it from active systems.

Deletion may take additional time in temporary backups and does not apply to limited records that we or Paddle must keep for tax, accounting, fraud prevention, security, dispute resolution, enforcement, or other legal obligations. Any retained record is restricted to that purpose and deleted when the applicable requirement ends. Content already published to a connected service remains there until you remove it through that service.

9. Data security

We use reasonable administrative, technical, and physical safeguards designed to protect personal data against loss, alteration, destruction, and unauthorized access, use, or disclosure. No online service can guarantee absolute security. You are responsible for protecting your account credentials and promptly notifying us of suspected unauthorized access.

10. Your privacy rights

Under Mexican law, you may exercise the ARCO rights to access your personal data, correct inaccurate or incomplete data, cancel data when appropriate, and oppose certain processing. You may also withdraw consent or ask us to limit the use or disclosure of your data, subject to applicable legal exceptions. Depending on where you live, local law may provide additional rights such as deletion, portability, restriction, or a complaint to a privacy authority.

To make a request, email privacy@markion.ai with your name, account email, the right you wish to exercise, a clear description of your request, and information that helps us locate the data. We may request reasonable proof of identity or authority before acting. We will respond within the period required by applicable law. For Mexican ARCO requests, we will communicate our determination within 20 business days and, when granted, implement it within the following 15 business days; a lawful extension may apply.

You may contact Mexico's competent data-protection authority if you believe your request was not handled in accordance with applicable law. We will not discriminate against you for exercising a privacy right.

11. Adults only

The Service is intended only for people who are at least 18 years old. We do not knowingly collect personal data from anyone under 18. If you believe a minor has provided data to Markion, contact us so we can investigate and delete it.

12. Changes to this policy

We may update this policy to reflect changes to Markion, our practices, or applicable law. We will post the revised policy at this URL, update the effective date, and provide additional notice through the Service or by email when a change is material or when law requires it.
