These Terms of Service are an agreement between you and Markion AI ("Markion," "we," "us," or "our"), a company based in Mexico. They govern your access to and use of markion.ai and the related Markion services, software, and features (collectively, the "Service"). By creating an account, subscribing, or using the Service, you agree to these terms. If you use the Service for an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
1. Eligibility and accounts
You must be at least 18 years old and able to enter a binding agreement to use the Service. You are responsible for providing accurate account information, keeping your credentials confidential, and all activity under your account. Notify us promptly at support@markion.ai if you suspect unauthorized access.
2. The Service
Markion provides marketing planning, content generation, scheduling, publishing, and related tools. We may change, improve, suspend, or discontinue features from time to time. We do not promise that the Service will be uninterrupted, error-free, or suitable for every business purpose.
AI-generated content can be inaccurate, incomplete, biased, or unsuitable for your audience. You must review and approve content before using or publishing it, and you are responsible for the decisions and results that follow from your use of the Service.
3. Subscriptions, billing, and cancellation
Paid features are provided through the plan and billing period you select. Subscriptions renew automatically for the same period unless you cancel before the next renewal. Prices, taxes, renewal timing, and any trial terms are shown at checkout. Paddle.com is the merchant of record for orders processed through its platform and handles payment processing, applicable taxes, subscription billing, and payment support.
You may cancel through the billing portal or by contacting us. Cancellation normally takes effect at the end of the current paid period, and you will not receive a refund for unused time unless required by law or approved under the applicable refund policy. We may suspend access for overdue, reversed, or fraudulent payments.
4. Your content and responsibilities
You retain ownership of the text, data, images, and other material that you submit to the Service ("Customer Content"). You grant Markion a limited, non-exclusive license to host, process, transmit, and display Customer Content only as needed to provide, secure, support, and improve the Service, or as described in our Privacy Policy.
You represent that you have the rights and permissions needed for your Customer Content and instructions. You must not submit content that is unlawful, infringing, deceptive, discriminatory, harmful, or invasive of another person's privacy, or use the Service to violate a third party's terms.
5. Acceptable use
You may not misuse the Service, circumvent security or usage limits, probe or disrupt our systems, upload malware, impersonate another person, access another account without permission, or use the Service to send spam or unlawful communications. We may remove content or restrict activity that we reasonably believe violates these terms or threatens the Service, our users, or others.
6. Markion intellectual property
Markion and its licensors own the Service, including its software, design, documentation, trademarks, and underlying technology. We give you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription in accordance with these terms. No ownership rights are transferred to you.
7. Third-party services
The Service may connect to third-party services such as WordPress, Facebook, Instagram, TikTok, Auth0, and Paddle. Those services are controlled by their respective providers and governed by their own terms and privacy notices. You authorize Markion to act on your connected accounts only as you direct, and you are responsible for maintaining the permissions and accounts needed for those connections.
8. Privacy and security
Our Privacy Policy explains how we handle personal data. We use reasonable safeguards, but no online service is completely secure. You must not use the Service to store sensitive information that it is not designed to handle, including payment-card numbers, government identifiers, health information, or biometric data.
9. Suspension and termination
You may stop using the Service or request account deletion at any time. We may suspend or terminate access if you breach these terms, create risk or legal exposure, fail to pay, or use the Service in a way that could harm Markion, users, or third parties. Where practical, we will provide notice and an opportunity to remedy the issue. Sections that by their nature should survive termination will continue to apply.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind. Markion does not warrant that the Service or generated content will be accurate, complete, secure, continuously available, or fit for a particular purpose. You are responsible for reviewing outputs and maintaining copies of important Customer Content.
To the maximum extent permitted by law, Markion will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Markion's total liability for claims relating to the Service will not exceed the amount you paid to Markion for the Service during the twelve months before the event giving rise to the claim. Nothing in these terms limits liability that cannot legally be limited.
11. Indemnity
To the extent permitted by law, you agree to defend and indemnify Markion and its affiliates, personnel, and service providers from claims, losses, and reasonable costs arising from your Customer Content, your misuse of the Service, your violation of these terms, or your violation of another person's rights or law.
12. Governing law and changes
These terms are governed by the laws of Mexico, without regard to conflict-of-law rules. The courts with jurisdiction where Markion is based in Mexico will have jurisdiction, except where mandatory law provides otherwise. If a provision is unenforceable, the remaining provisions remain in effect.
We may update these terms when the Service, our practices, or applicable law changes. We will post the updated terms, change the effective date, and provide additional notice for material changes when required. Your continued use after the effective date means you accept the updated terms.
